Binek – KVKK and Privacy Policy

Thank you for using the Binek application (“Application”).

This KVKK and Privacy Policy (“Policy”) has been prepared to explain how your personal data is collected, for what purposes it is processed, with whom it may be shared, how long it is stored, and your rights regarding your personal data within the scope of the Personal Data Protection Law No. 6698 (“KVKK”).

1. Data Controller

Within the scope of the KVKK, the data controller regarding your personal data is the person or entity responsible for the operation of the Binek application.

2. Processed Personal Data

During your use of Binek, depending on the features you use, the following categories of personal data may be processed:

• Identity and Contact Information: Name, surname, and email address.

• Account Information: Information regarding your account and password. Passwords are not stored in plain text and are securely protected.

• Vehicle Information: Vehicle make and model, license plate, mileage, and other vehicle information you add to the application.

• Fuel and Expense Records: Fuel purchases, expenses, and related records.

• Maintenance Records: Vehicle maintenance operations, service history, and related records.

• Insurance Records: Traffic insurance, comprehensive insurance (kasko), and related date and record information.

• Travel Records: Travel and usage records created through the application.

• Location Information: Location information that may be used to support travel and usage features, only if you grant the necessary device permissions.

• Notification and Technical Information: Device and notification token information required for sending push notifications, and technical information that may be necessary for the secure and proper operation of the application.

3. Method of Collecting Personal Data

Your personal data may be collected electronically through the following methods:

• You entering information directly into the Application,

• You creating vehicle, fuel, maintenance, insurance, or travel records,

• You using the features of the Application,

• You granting relevant permissions via your device,

• You enabling application notifications.

4. Purposes of Processing Personal Data

Your personal data is processed in a manner connected, limited, and proportionate to the purpose of enabling Binek to provide its services.

In this context, your data may be processed for the purposes of;

• Creating and managing your user account,

• Storing your vehicle information and vehicle history,

• Keeping fuel, maintenance, insurance, travel, and expense records,

• Sending reminders and application notifications,

• Operating application features,

• Ensuring the security of the application,

• Preventing unauthorized use and abuse,

• Providing services requested by the user.

Binek does not use your personal data for advertising, marketing, user profiling, or behavioral advertising purposes.

Your location information is also not used for advertising, marketing, user profiling, or third-party advertising services.

5. Legal Grounds for Processing Personal Data

Your personal data is processed within the scope of the legal grounds specified in Article 5 of the KVKK.

Depending on the nature of the processing, your personal data may be based on legal grounds such as;

• Being directly related to the establishment or performance of a contract,

• The data controller fulfilling its legal obligation,

• Processing being necessary for the legitimate interest of the data controller, provided it does not harm the fundamental rights and freedoms of the data subject,

• Being expressly provided for in the laws,

• Having your explicit consent in cases where processing is subject to your explicit consent.

Data requiring device permissions, such as location, may be processed in accordance with obtaining the necessary permissions from your device to use the relevant feature.

6. Sharing of Personal Data

Binek does not sell, rent, or transfer your personal data to third parties for advertising purposes.

However, a limited amount of data may be shared with relevant service providers to provide the technical services necessary for the Application to function.

For example, technical infrastructure services such as Firebase Cloud Messaging (FCM) may be utilized for sending application notifications.

Only information necessary for the provision of the relevant service is shared with these service providers.

Your personal data may also be transferred to relevant parties in cases that are legally required or permitted, such as;

• Fulfilling legal obligations,

• Meeting lawful requests from authorized public institutions or organizations,

• Protecting the security of the application and its users.

7. International Data Transfer

The servers of some technical infrastructure or service providers used by Binek may be located outside of Turkey.

Therefore, depending on the nature of the services used, the transfer of your personal data abroad may occur.

In the event that an international data transfer takes place, the transfer is carried out in accordance with the conditions specified in the KVKK and relevant secondary legislation.

8. Storage and Deletion of Personal Data

Your personal data is stored for the duration required by the purposes of processing and by taking into account the legal retention and statute of limitations periods stipulated in the relevant legislation.

If you delete your account through the Application, your personal data and records associated with your account will be deleted from our systems or anonymized where necessary, provided that data that must be legally retained is preserved.

9. Data Security

Appropriate technical and administrative security measures are implemented to protect your personal data against;

• Unauthorized access,

• Loss or misuse,

• Unauthorized alteration,

• Unlawful processing.

Secure communication protocols and, where appropriate, encryption methods are used during data transfer. Access to stored data is restricted by authorization and access control mechanisms.

However, it cannot be guaranteed that any data transfer or electronic storage method over the internet is completely secure.

10. Children's Privacy

Binek is not designed for children.

We do not knowingly collect personal data from children under the age of 13. If we learn that such data has been transmitted to us, we will take reasonable and necessary steps to delete the relevant data.

11. Your Rights Under the KVKK

Within the scope of Article 11 of the KVKK, you have the following rights as a data subject:

• To learn whether your personal data is being processed,

• To request information if your personal data has been processed,

• To learn the purpose of processing your personal data and whether it is used in accordance with its purpose,

• To know the third parties to whom your personal data is transferred domestically or abroad,

• To request correction of your personal data if it is incomplete or incorrectly processed,

• To request the deletion or destruction of your personal data within the framework of the conditions stipulated in the KVKK,

• To request notification of the correction, deletion, or destruction operations to third parties to whom your personal data has been transferred,

• To object to a result arising against you as a result of the analysis of processed personal data exclusively through automated systems,

• To request compensation for damages in case you suffer damage due to the unlawful processing of your personal data.

12. Policy Changes

This Policy may be updated from time to time in line with changes in legal regulations or updates made to Binek's services and features.
